TERMS AND CONDITIONS OF EDU-DUTCH ACADEMY B.V.

This Regulation applies as of 1 January 2026


General Provisions

These Terms and Conditions set out the rules governing the provision of educational services by Edu-Dutch Academy B.V., including in particular:

  • the conditions for the purchase and provision of Dutch language courses offered in the form of digital content (e-learning courses),
  • the rules governing participation in online group courses and individual lessons provided remotely.

The administrator of the website available at www.edu-dutch.com and the entity responsible for the provision of the Courses is:

Edu-Dutch Academy B.V., having its registered office at Tine van Dethstraat 81, 2331 CD Leiden, the Netherlands, registered with the Dutch Chamber of Commerce under number 94710732, email address: info@edu-dutch.com.

All inquiries regarding the operation of the Platform, the Course offering, or the terms of use of the services may be directed to:

Email communication is the preferred method of contact.
Messages are handled on business days (Monday through Friday) between 09:00 and 17:00, within a maximum period of 48 hours.


1. Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

Platform – the website available at www.edu-dutch.com, including any of its extensions or functionalities.

User / Participant – a natural person using the Platform, including placing an order or participating in a Course.

Consumer – a natural person acting for purposes which are outside his or her trade, business, craft or profession.

Entrepreneur acting as a consumer – a natural person who enters into an agreement with Edu-Dutch Academy B.V. directly related to his or her business activity, where it follows from the content of that agreement that it does not have a professional character for that person, in particular in light of the subject of the business activity as registered in the relevant commercial register.

Course – an educational product offered by Edu-Dutch Academy B.V., provided in the form of:

  • an e-learning course (digital content made available online),
  • an online group course (live lessons conducted by an instructor),
  • individual online lessons (live lessons conducted by an instructor).

Terms and Conditions / Regulation – this document setting out the terms governing the use of the educational services provided by Edu-Dutch Academy B.V.


2. Introductory Provisions

2.1. By using the Edu-Dutch Platform, the User may in particular:

  • view publicly accessible content of the Platform,
  • create a user account or use an existing account,
  • purchase and/or participate in Dutch language courses (including e-learning courses, online group courses, and individual lessons),
  • contact Edu-Dutch Academy B.V. via the available communication channels.

2.2. The activities referred to above constitute electronic services within the meaning of applicable legislation and are provided by Edu-Dutch Academy B.V. to the User.

2.3. No specific technical requirements apply to the use of the Platform. The following are sufficient:

  • access to the Internet,
  • a standard and up-to-date operating system,
  • a standard and up-to-date web browser with cookies enabled,
  • an active email account.

2.4. Viewing generally accessible content of the Platform is possible anonymously, without the need to provide personal data. The provision of personal data is required for the creation of a user account, the purchase of a Course, and the use of contact functionalities with Edu-Dutch Academy B.V., insofar as this is necessary for the performance of the relevant service.

2.5. The User is prohibited from providing unlawful content, in particular via the forms made available on the Platform. Detailed rules in this respect are set out in the Annex to these Terms and Conditions.

2.6. An electronic contact point has been designated in relation to the Platform for direct communication: info@edu-dutch.com.
This address also serves for rapid and direct communication between the User and Edu-Dutch Academy B.V. Communication may take place in Dutch, Polish, or English.

2.7. In order to ensure the security of data transmission and the protection of Users’ personal data, Edu-Dutch Academy B.V. applies appropriate technical and organisational measures, taking into account the risks associated with the provision of electronic services, in particular measures aimed at preventing unauthorised access to or modification of data.

2.8. Edu-Dutch Academy B.V. makes every effort to ensure the proper and uninterrupted functioning of the Platform. Any malfunctions, errors, or interruptions in the functioning of the Platform should be reported without undue delay via email.

2.9. The Platform constitutes an information system managed by Edu-Dutch Academy B.V. In this respect, Edu-Dutch Academy B.V. reserves the right to carry out maintenance, modernisation, and update works aimed at improving the quality of services and further developing the functionality of the Platform.


3. User Account

3.1. A user account is created automatically as a result of completing and submitting the order form. Having a user account is necessary for the performance of the ordered Course, both in the form of e-learning and group or individual lessons.

3.2. Submission of the order form results in the conclusion of an agreement for the maintenance of a user account between the User and Edu-Dutch Academy B.V. Under this agreement, Edu-Dutch Academy B.V. undertakes to provide the User with access to the account and to enable the use of its functionalities, while the User undertakes to use the account in accordance with these Terms and Conditions, applicable law, and the principles of social conduct.

3.3. The agreement for the maintenance of a user account is concluded for an indefinite period.

3.4. Access to the user account is obtained using an email address and a password set by the User. The User is responsible for maintaining the confidentiality of these credentials. Edu-Dutch Academy B.V. shall not be liable for the consequences of access by unauthorised persons to the user account where such access was possible due to circumstances attributable to the User (e.g. sharing login details with third parties or insufficient protection of access data).

3.5. Within the user account, it is possible to configure:

  • a username (visible to other participants in group courses),
  • an avatar (e.g. a profile picture).

3.6. By setting a username and/or avatar, the User consents to their dissemination within the Platform, in particular in connection with participation in group courses.

3.7. The username and avatar must not contain vulgar, offensive, infringing, or otherwise unlawful content, nor content contrary to public decency. Detailed rules in this respect are set out in the Annex to these Terms and Conditions.


4. Educational Courses

4.1. Information regarding available Courses, their variants, content, and prices is available on the website: www.edu-dutch.com.

4.2. The purchase of a Course is carried out by:

  • selecting the appropriate Course variant (e-learning or online course, either individual or group-based),
  • adding it to the shopping cart,
  • completing and submitting the order form.

By placing an order, an agreement is concluded for the paid provision of content constituting the Course.

4.3. The price of the Course shall be paid:

  • in full in advance, or
  • in instalments (subscription), where such an option has been made available and approved by an external payment provider. The decision regarding the availability of instalment payments rests solely with the payment provider, and Edu-Dutch Academy B.V. has no influence over the outcome of such assessment.

4.4. Available payment methods:

  • bank transfer to the bank account of Edu-Dutch Academy B.V.,
  • online payments via the payment provider Stripe.

For certain Courses, payment in instalments is possible exclusively via the Stripe subscription system, in accordance with the terms specified during the ordering process.

4.5. Upon request of the User, an invoice shall be issued and sent electronically to the email address associated with the user account.

4.6. Access to the e-learning Course is granted:

  • for a period of 12 months from the date of receipt of payment.

4.7. In the case of Courses with unlimited access, if it becomes necessary to terminate the user account (e.g. due to technological changes or discontinuation of the activities of Edu-Dutch Academy B.V.), the User shall be granted the possibility to download all digital content of the purchased Course onto their own data carrier. The period for downloading shall not be shorter than 14 days and shall be specified in an email sent to the address associated with the user account.

4.8. The digital content constituting the Course is made available via the user account on the Platform. The content is organised in the form of lessons.

4.9. The study load amounts on average to 3–5 hours per week, depending on the type of Course and the pace of the Participant.

4.10. Assessment: Courses may include online assessments. Evaluation is carried out based on predefined criteria within the LMS. Participants may, where applicable, retake assessments.

4.11. During the period of access to the Course, the User may:

  • submit substantive questions relating to the course material by using the course group or by sending a private message to the instructor, in accordance with the rules described in § 5 of these Terms and Conditions.

5. Online Group Courses

5.1. The group courses offered by Edu-Dutch Academy B.V. constitute educational services provided on a specific date or within a clearly defined period, within the meaning of Article 6:230p(e) of the Dutch Civil Code.

5.2. In the case of group courses that commence before the expiry of 14 days from the conclusion of the agreement, the Participant may lose the right of withdrawal if:

  • the Participant has consented to the commencement of the Course before the expiry of the withdrawal period,
  • the Participant has been informed of the loss of the right of withdrawal in connection with the commencement of the Course, including the dispatch of learning materials (e.g. a physical book).

5.3. The consent referred to above is given by selecting the appropriate checkbox in the registration form.

5.4. The dispatch of physical learning materials, such as a textbook, may be considered as the commencement of the performance of the agreement. If the User has expressly consented in advance to the performance of the agreement before the end of the withdrawal period and has been informed of the possible loss of the right of withdrawal, the right of withdrawal may be lost (in whole or in part), in accordance with Article 6:230p of the Dutch Civil Code.

5.5. If the Course commences in accordance with the established schedule and/or learning materials have been dispatched, the Participant is obliged to pay the full Course price, even if they do not continue participation in the lessons.

5.6. Participants in a group course may not unilaterally suspend their participation. In the event of absence, for example due to health reasons or other circumstances beyond the control of Edu-Dutch Academy B.V., the Participant retains access to the course materials on the e-learning platform. At the Participant’s request, access to the platform may be extended free of charge as a form of compensation. Absence from lessons does not entitle the Participant to a refund or to a proportional reduction of the Course price.

5.7. No later than 7 days prior to the scheduled start date, the Participant shall be informed by email and/or telephone whether the Course will take place. If the Course cannot commence on the planned date, a new start date shall be communicated.

Edu-Dutch Academy B.V. reserves the right to postpone the scheduled start date of a group course if there are insufficient registrations (minimum of 5 Participants) to form a group. In such a case, the Participant shall have the option to wait for the Course on the new start date or to cancel participation.

If the Participant chooses to cancel participation, they shall be entitled to a full refund of the Course fee already paid. Such refund shall be made within 14 days of cancellation.

5.8. Online lessons within a group course are conducted via remote communication tools such as Zoom, on dates determined in advance by Edu-Dutch Academy B.V. Edu-Dutch Academy B.V. reserves the right to make changes to the schedule, including rescheduling lessons or appointing a substitute instructor, in the event of circumstances beyond its control, such as instructor illness or other unforeseen situations.


6. Individual Online Lessons

6.1. The individual courses offered by Edu-Dutch Academy B.V. constitute educational services provided at specific times individually agreed upon with the Participant.

6.2. If an individual course commences before the expiry of 14 days from the conclusion of the agreement, the Participant may lose the right of withdrawal if:

  • the Participant has expressly consented to the commencement of the Course before the expiry of the withdrawal period,
  • the Participant has been informed of the possible loss of the right of withdrawal in connection with the commencement of the Course, including the dispatch of learning materials (e.g. a physical book).

6.3. The consent referred to above is given by selecting the appropriate checkbox in the registration form.

6.4. The dispatch of physical learning materials, such as a textbook, may be considered as the commencement of the performance of the agreement. If the Participant has expressly consented in advance to the performance of the agreement before the end of the withdrawal period and has been informed of the possible loss of the right of withdrawal, the right of withdrawal may be lost (in whole or in part), in accordance with Article 6:230p of the Dutch Civil Code.

6.5. If the Course commences in accordance with the agreed schedule and/or learning materials have been dispatched, the Participant is obliged to pay the full Course price, even if they do not continue participation in the lessons.

6.6. Online lessons within an individual course are conducted via remote communication tools such as Zoom, at times individually agreed between Edu-Dutch Academy B.V. and the Participant. Lesson dates may be changed or cancelled for reasons beyond the control of Edu-Dutch Academy B.V., for example in the event of instructor illness.

The Participant has the right to reschedule a planned lesson, provided that this is communicated no later than 24 hours prior to the scheduled start of the lesson. Notifications may be made via one of the following communication channels:

6.7. If no notification is made within the above-mentioned period, the lesson shall be deemed to have been delivered and no right to rescheduling or refund shall arise. Lessons are conducted regularly, once per week or once every two weeks, in accordance with the arrangements between the parties.

The Participant may temporarily suspend participation in an individual course, provided that this is communicated in advance, stating the reason, and subject to the approval of Edu-Dutch Academy B.V.


7. E-learning Courses

7.1. The e-learning courses offered by Edu-Dutch Academy B.V. constitute educational services provided in the form of digital content not supplied on a tangible medium, and may also include physical learning materials, such as a textbook.

7.2. In the case of e-learning courses where access is granted before the expiry of 14 days from the conclusion of the agreement, the Participant may lose the right of withdrawal if:

  • the Participant has expressly consented to the commencement of the performance of the Course before the expiry of the withdrawal period,
  • the Participant has been informed of the loss of the right of withdrawal in connection with the supply of digital content,
  • the Participant has been informed of the possible loss of the right of withdrawal in connection with the dispatch of learning materials (e.g. a physical book).

7.3. The consent referred to above is given by selecting the appropriate checkbox in the registration or order form.

7.4. Making digital content available via the user account or dispatching learning materials shall be deemed to constitute the commencement of the performance of the agreement. If the Participant has expressly consented in advance to the performance of the agreement before the expiry of the withdrawal period and has been informed of the loss of the right of withdrawal, the right of withdrawal shall be excluded in accordance with Article 6:230p of the Dutch Civil Code.

7.5. If the Course is commenced by making e-learning content available and/or by dispatching a textbook, the Participant is obliged to pay the full Course price, even if they do not make use of the Course.


8. Copyright

8.1. All content made available on the Platform, including in particular texts, photographs, video recordings, and other multimedia materials, is protected by copyright law. It is prohibited to copy, distribute, reproduce, or otherwise use such content without the prior written consent of Edu-Dutch Academy B.V. Such actions may result in civil and/or criminal liability.

8.2. Materials forming part of the Courses (including, but not limited to, video lessons, exercises, PDF files, and audio recordings) are subject to copyright protection. Edu-Dutch Academy B.V. grants Participants a non-exclusive, non-transferable, and territorially unlimited licence to use these materials solely for their personal use in connection with learning the Dutch language within the purchased Course. It is prohibited to further distribute, copy, publish, or use these materials for commercial purposes.

8.3. If the Participant receives a physical book or workbook as part of the course materials, such materials are also protected by law. Copying, scanning, distributing, or sharing their content with third parties without the consent of the rights holder (e.g. the publisher) is prohibited.

8.4. In the event of a breach of the above provisions, Edu-Dutch Academy B.V. reserves the right to terminate cooperation with immediate effect, block access to the Course, and, where necessary, pursue legal action.


9. Prohibited Conduct

9.1. The User undertakes to use the Platform in accordance with applicable law, these Terms and Conditions, and the principles of social conduct. In particular, it is prohibited to:

  • share the user account with others, including providing login credentials (email address and password) to third parties,
  • attempt to obtain unauthorised access to resources or functionalities of the Platform not assigned to the User’s account,
  • undertake actions that may disrupt the functioning of the Platform or the IT system, in particular through the use of malicious software, hacking attempts, or other techniques,
  • use the user account for marketing, promotional, or sales purposes unrelated to language learning within Edu-Dutch Courses,
  • infringe copyright in respect of materials available on the Platform, including copying, distributing, modifying, or sharing content without consent,
  • use tools available on the Platform (such as chats, comments, or groups) in a manner that violates the personal rights of others, is contrary to the principles of social conduct, or violates public decency,
  • publish prohibited content, including content that is vulgar, offensive, hateful, discriminatory, or otherwise in violation of the Annex to these Terms and Conditions.

9.2. In the event of a breach of any of the above prohibitions, Edu-Dutch Academy B.V. reserves the right to block access to the user account and, consequently, to the purchased Courses. In such a case, the User shall receive a statement of reasons for the decision via email. The User has the right to lodge an objection within 14 days of receiving notification of the blocking. Objections shall be reviewed within 14 days of receipt.


10. Right of Withdrawal

10.1. If you are a Consumer or a natural person acting outside your trade, business, craft, or profession, you have the right to withdraw from a distance contract concluded with Edu-Dutch Academy B.V. without giving any reason within 14 days from the date of conclusion of the agreement, in accordance with Article 6:230o of the Dutch Civil Code, unless one of the exceptions set out in Article 6:230p of the Dutch Civil Code applies.

The right of withdrawal may be lost (in whole or in part) if:

  • you have expressly consented to the commencement of the performance of the service (e.g. participation in online group or individual lessons) before the expiry of the withdrawal period;
  • you have obtained access to digital content not supplied on a tangible medium (e.g. e-learning), after having expressly consented in advance to immediate delivery and having acknowledged that you thereby waive your right of withdrawal;
  • physical learning materials (e.g. a book) have been delivered to you and cannot be returned for reasons of hygiene, personalisation, or use, to the extent permitted by law.

10.2. In order to exercise the right of withdrawal, you must submit an unambiguous statement by email to: info@edu-dutch.com. You may use a model withdrawal form, but this is not mandatory.

10.3. If the withdrawal is validly exercised:

  • access to the Course shall be terminated,
  • all payments made by you shall be refunded without undue delay and in any event no later than 14 days from the receipt of your withdrawal statement.

10.4. The refund shall be made using the same means of payment as that used for the original transaction, unless you have expressly agreed otherwise, without incurring any additional costs.

Any refunds shall be processed within 14 days following approval of the withdrawal or refund request.


11. Complaints

11.1. Edu-Dutch Academy B.V. provides electronic services to Participants with due care and in compliance with applicable laws and regulations.

11.2. In the event of the purchase of a Course (e-learning, group course, or individual course), Edu-Dutch Academy B.V. is liable towards the Consumer for the conformity of the service with the agreement, in accordance with Articles 7:17 and 7:50aa of the Dutch Civil Code.

11.3. If the Course does not conform to the agreement (e.g. errors preventing learning, non-functioning lessons, or missing content), you have the right to submit a complaint. Complaints may be submitted by email to: info@edu-dutch.com.

11.4. In your complaint, you are requested to provide the following information:

  • identification details (name, email address associated with the account),
  • order number (if available),
  • description of the lack of conformity,
  • preferred solution.

11.5. Complaints shall be treated confidentially. They shall be handled as soon as possible, and no later than 14 days from receipt. You will be informed of the outcome by email.

11.6. If you are a Consumer, you also have the right to make use of out-of-court dispute resolution mechanisms, including:

  • submitting a complaint via the European ODR platform: https://ec.europa.eu/consumers/odr
  • submitting a dispute to a recognised dispute resolution body in the Netherlands, such as a committee affiliated with the Dutch Consumer Complaints Boards Foundation (SGC),
  • mediation via an independent mediator.

11.7. More information on out-of-court dispute resolution is available via the website of the Netherlands Authority for Consumers and Markets or European consumer platforms.

11.8. If a complaint cannot be resolved amicably, the Participant may refer the matter to an independent third party:

This independent third party may issue a binding decision. Subsequently, both parties retain the right to bring the matter before a court.
The decision of this professional body shall be binding on Edu-Dutch Academy B.V. Any resulting consequences shall be implemented by Edu-Dutch Academy B.V. within reasonable and specified timeframes.

11.9. Complaints and the manner of their resolution shall be recorded and retained for a period of at least 2 years.


12. Privacy

12.1. The controller of the personal data of Course Participants is Kinga Fiebig, director of Edu-Dutch Academy B.V., having its registered office at Tine van Dethstraat 81, 2331 CD Leiden, the Netherlands. Personal data are processed for the purpose of performing the agreement, managing the user account, and ensuring the proper functioning of the Platform.

12.2. Use of the Platform involves the processing of personal data, as well as the use of cookies and similar tracking technologies.

12.3. Detailed information regarding:

  • the rules governing the processing of personal data,
  • your rights as a data subject,
  • the use of cookies and analytical technologies,

is available in the Privacy Policy at:

13. Final Provisions

13.1. The prices displayed on the Platform may be subject to change. Price changes shall not affect orders placed prior to the change—the price applicable at the time of conclusion of the agreement shall apply.

13.2. These Terms and Conditions may be amended for important reasons, in particular:

  • changes in applicable laws or regulations,
  • technological changes affecting the functioning of the Platform,
  • organisational or business changes within Edu-Dutch Academy B.V.

13.3. If you have a user account, you shall be informed of amendments to these Terms and Conditions electronically, by means of a message sent to the email address associated with your account.

13.4. If an amendment to these Terms and Conditions has a material and adverse effect on the use of the user account or the purchased Course, you have the right to terminate the agreement within 30 days from receipt of the information about the amendment.


14. Evaluation and Quality Assurance

After completion of the Course, Participants are invited to complete an evaluation.

The results of such evaluations are used to improve the quality of Courses, teaching materials, and services provided by Edu-Dutch Academy B.V.


Annex – Rules for User Content and Notice-and-Action Procedure (DSA-compliant)

Provision of Information by Users

When using the Platform, you may provide information which, at your request, is stored within the Platform systems, such as comments, questions, forum posts, or data in your user profile.

Prohibited Content

It is prohibited to publish or transmit information that:

  • constitutes illegal content within the meaning of the Digital Services Act (Regulation (EU) 2022/2065),
  • infringes intellectual property rights, personal data, reputation, or rules of fair competition,
  • is misleading or constitutes spam,
  • promotes violence, hatred, discrimination, or totalitarian ideologies,
  • is offensive, vulgar, discriminatory, sexist, or otherwise inappropriate,
  • harms the reputation of Edu-Dutch Academy B.V.

Reporting Illegal Content

Any person may report the presence of illegal content by sending an email to: info@edu-dutch.com

The report should include:

  • a statement of reasons for the report,
  • the exact location (URL) of the contested content,
  • contact details of the reporting person (unless the report concerns matters covered by Directive 2011/93/EU),
  • a statement confirming that the report is made in good faith.

Handling of Reports

Reports shall be processed within a maximum period of 14 days.

If the report is incomplete, the reporting person may be requested to provide additional information.

The reporting person shall be informed by email of the decision, including the reasoning and information on the possibility to lodge an objection.

Measures in Case of Violations

Depending on the nature and severity of the violation, Edu-Dutch Academy B.V. may:

  • restrict the visibility of content or remove it,
  • restrict the ability to publish new content,
  • temporarily block the user account,
  • permanently delete the user account.

Appeal Procedure

You have the right to lodge an objection against a decision within 14 days from receipt thereof, by submitting a reasoned objection to: info@edu-dutch.com

Objections shall be reviewed within 14 days of receipt.

No Automated Decision-Making

All reports, decisions, and objections are reviewed manually by the team of Edu-Dutch Academy B.V. No automated moderation or decision-making systems are used.

Abuse of the Reporting Procedure

In the event of repeated submission of manifestly unfounded reports, Edu-Dutch Academy B.V. reserves the right—after prior warning—to temporarily restrict the possibility of submitting reports.
