Terms and Conditions – Edu-Dutch
Effective from: 15 July 2025
General Provisions
These Terms set out the rules for the provision of educational services by Academy Edu-Dutch B.V., including:

rules for purchasing and using Dutch language courses delivered as digital content (e-learning courses);
-
rules for participating in live online group courses and one-to-one lessons delivered remotely.

Email is the most efficient contact method. We reply on business days (Monday–Friday), from 09:00 to 17:00, typically within two business days.
1. Definitions
For the purposes of these Terms:
-
Platform – the website available at www.edu-dutch.pl and its subpages.
-
User / Student – a natural person who uses the Platform, including placing an order or participating in a Course.
-
Consumer – a natural person making a purchase not directly related to their business or professional activity.

Sole Proprietor Acting as a Consumer (PNPK) – a natural person entering into a contract with Academy Edu-Dutch directly connected to their business, where the contract is not of a professional nature for that person, especially considering their business activity as listed in the Polish Central Register and Information on Economic Activity.

Course – an educational product offered by Academy Edu-Dutch, delivered as:
-
an e-learning course (digital content available online),
-
a live online group course (real-time classes led by a teacher),
-
live online individual lessons (one-to-one classes led by a teacher).

Terms – this document governing the use of Academy Edu-Dutch educational services.
2. Preliminary Provisions
2.1. By using the Edu-Dutch Platform, the User may in particular:
-
browse publicly available content;
-
create an account or use an existing account;
-
purchase and/or take Dutch Courses (e-learning, group, or individual);
-
contact Academy Edu-Dutch via available channels.
2.2. The above activities are electronic services under applicable law and are provided by Academy Edu-Dutch to the User.
2.3. No special technical requirements are needed. The following are sufficient:
-
Internet access;
-
a standard, up-to-date operating system;
-
a standard, up-to-date web browser with cookies enabled;
-
an active email address.
2.4. Public content can be viewed anonymously. Creating an account, purchasing a Course, or using the contact function requires providing personal data necessary to deliver the service.
2.5. Users must not submit unlawful content, in particular via forms on the Platform. Detailed rules are set out in the Annex to these Terms.
2.6. An electronic contact point for the Platform is designated for direct communication: info@edu-dutch.com. Users may use this address for quick and direct communication with Academy Edu-Dutch. Communication may be in Polish or English.
2.7. To ensure data transmission security and protect Users’ personal data, Academy Edu-Dutch implements appropriate technical and organisational measures proportionate to the risks of providing electronic services, particularly measures preventing unauthorised acquisition or alteration of data.
2.8. Academy Edu-Dutch takes all steps to ensure proper and uninterrupted operation of the Platform. Any irregularities, errors, or interruptions should be reported immediately by email.
2.9. The Platform is an IT system managed by Academy Edu-Dutch. We may carry out maintenance, upgrades, and updates to improve service quality and develop Platform features.
3. User Account
3.1. A User account is created automatically when the order form is completed and submitted. An account is necessary to access the purchased Course (e-learning, group, or individual).
3.2. Submitting the order form concludes a contract for maintaining a User account between the User and Academy Edu-Dutch. Under this contract, Academy Edu-Dutch provides access to the account and its features; the User agrees to use the account in compliance with the Terms, applicable law, and good practice.
3.3. The account-maintenance contract is concluded for an indefinite period.
3.4. Login is by email address and password. The User is responsible for keeping these credentials confidential. Academy Edu-Dutch is not liable for consequences of unauthorised access where such access was possible due to the User (e.g., sharing credentials, lack of adequate safeguards).
3.5. Within the account, the User may set:
-
a username (visible to other participants in group courses),
-
an avatar (e.g., profile photo).
3.6. By setting a username and/or avatar, the User consents to their dissemination within the Platform, in particular in the context of group courses.
3.7. The username and avatar must not contain vulgar, offensive, third-party-infringing, or otherwise unlawful or improper content. Details are in the Annex.
4. Educational Courses
4.1. Courses offered by Academy Edu-Dutch are paid. Information about available Courses, variants, scope, and prices is on www.edu-dutch.com.
4.2. Purchasing a Course involves:
-
selecting the appropriate Course variant (e-learning or online individual),
-
adding it to the cart,
-
completing and submitting the order form.
Submitting an order concludes a contract for paid delivery of the digital content constituting the Course.
4.3. Course fees are payable:
-
in full in advance, or
-
in instalments (subscription) if this option is enabled and approved by the external payment operator. Eligibility for instalments is determined solely by the payment operator; Academy Edu-Dutch does not influence the assessment outcome.
4.4. Available payment methods:
-
bank transfer to the Academy Edu-Dutch account;
-
online payments via Stripe.
For some courses, instalments may be available exclusively via Stripe subscriptions, under the terms shown during checkout.
4.5. An invoice is issued on the User’s request and sent electronically to the email address linked to the account.
4.6. Access to an e-learning Course is granted:
-
for 12 months from the date the payment is booked.
4.7. For Courses with lifetime access, if it becomes necessary to close a User account (e.g., due to technological changes or Academy Edu-Dutch ceasing operations), the User will be able to download all digital content comprising the purchased Course to their own storage. The download window will be no shorter than 14 days and will be communicated by email to the address linked to the account.
4.8. The digital content of the Course is provided via the User account on the Platform and organised as lessons.
4.9. During the access period, the User may:
-
ask substantive questions about the material via the student group function or by private message to the instructor—under the rules in §5 of these Terms.
5. Live Online Group Courses
5.1. Group courses offered by Academy Edu-Dutch are educational services provided at specific dates, within the meaning of Article 38(12) of the Polish Consumer Rights Act of 30 May 2014.
5.2. For group courses starting before 14 days from contract conclusion, the Participant may lose the right of withdrawal if:
-
they consented to the course starting before the withdrawal period ends;
-
they were informed about losing the right of withdrawal due to the course starting, including in connection with dispatch of educational materials (e.g., a paper book).
5.3. This consent is given by ticking the appropriate checkbox in the registration form.
5.4. Dispatch of physical educational materials (e.g., a textbook) by Academy Edu-Dutch constitutes commencement of performance of the contract for delivery of educational content and services tailored to the consumer’s individual needs, which—under Article 38(3) of the Consumer Rights Act—excludes the right of withdrawal.
5.5. If the course starts according to schedule and/or materials have been dispatched, the Participant must pay the full course price even if they do not attend further classes.
5.6. A group-course participant cannot unilaterally suspend participation. If absent for reasons such as health or other circumstances beyond Academy Edu-Dutch’s control, the participant retains access to e-learning materials. On request, access to the platform may be extended free of charge as compensation. Absence does not entitle the participant to a refund or pro-rata reduction.
5.7. Academy Edu-Dutch may postpone the start date of a group course if there are insufficient enrolments to form a group. Enrolled Participants will be promptly informed of a new proposed start date and may choose to wait or cancel participation.
5.8. Group lessons are held via remote communication tools such as Zoom, on dates set in advance by Academy Edu-Dutch. We may change the schedule, including rescheduling a lesson or assigning a substitute teacher, if circumstances beyond our control occur (e.g., teacher illness or force majeure).
6. Live Online Individual Lessons
6.1. Individual courses are educational services delivered at specific dates arranged individually with the Participant.
6.2. For individual courses starting before 14 days from contract conclusion, the Participant may lose the right of withdrawal if:
-
they consented to the course starting before the withdrawal period ends;
-
they were informed about losing the right of withdrawal due to the course starting, including in connection with dispatch of educational materials (e.g., a paper book).
6.3. This consent is given by ticking the appropriate checkbox in the registration form.
6.4. Dispatch of physical educational materials (e.g., a textbook) constitutes commencement of performance of the contract for delivery of educational content and services tailored to the consumer’s individual needs, which—under Article 38(3) of the Consumer Rights Act—excludes withdrawal.
6.5. If the course starts as scheduled and/or materials have been dispatched, the Participant must pay the full price even if they do not continue.
6.6. Individual lessons are held via tools such as Zoom, at times agreed individually between Academy Edu-Dutch and the Student. Sessions may be rescheduled or cancelled for reasons beyond Academy Edu-Dutch’s control (e.g., teacher illness). The Student may reschedule a booked lesson provided they notify us no later than 24 hours before the scheduled start of the next session, via:

6.7. If notice is not given within the above timeframe, the lesson is deemed delivered and cannot be rescheduled or refunded. Lessons are held regularly (weekly or bi-weekly) as agreed. The Student may temporarily suspend participation in an individual course, subject to prior notice with justification and Academy Edu-Dutch’s consent.
7. E-learning Courses and Books
7.1. E-learning courses are educational services delivered as digital content not supplied on a tangible medium and may include physical educational materials, such as a textbook.
7.2. For e-learning courses where access is granted before 14 days from contract conclusion, the Participant may lose the right of withdrawal if:
-
they consented to performance before the withdrawal period ends;
-
they were informed about losing the right of withdrawal due to the start of digital-content delivery;
-
they were informed about losing the right due to dispatch of educational materials (e.g., a paper book).
7.3. This consent is given by checking the appropriate box in the registration/purchase form.
7.4. Making digital content available within the User account or dispatching educational materials constitutes the start of performance under Article 38(13) and Article 38(3) of the Consumer Rights Act. From that moment, the Participant loses the right of withdrawal.
7.5. Once the course has started by granting access to e-learning content and/or dispatching the textbook, the Participant must pay the full course price even if they do not use it.
7.6. Under Article 38(13) and Article 38(3) of the Consumer Rights Act: when purchasing a book via www.edu-dutch.pl, the Consumer also receives access to the Academie Edu-Dutch platform (digital content: audio recordings, answer keys). This service begins before 14 days from purchase—with the Consumer’s explicit consent—which results in loss of the right of withdrawal for the book purchase. To protect the Seller’s legitimate interests and comply with the law, during checkout the Consumer is asked to tick:
“I consent to the commencement of the service (access to educational materials) before 14 days from purchase and acknowledge that I lose the right of withdrawal.”
8. Copyright
8.1. All content on our Platform—texts, photos, videos, and other multimedia—is protected by copyright. Copying, sharing, reproducing, or using such content without our written consent is prohibited and may result in civil or criminal liability.
8.2. Course materials (e.g., video lessons, exercises, PDFs, audio files) are protected by copyright. We grant participants a non-exclusive, non-transferable, territory-unlimited licence to use these materials for personal study purposes only within the purchased course. Further sharing, copying, publishing, or commercial use is prohibited.
8.3. If a participant receives a paper book or workbook as part of the course, these are also legally protected. Copying, scanning, distributing, or sharing their content with third parties without the copyright holder’s consent (e.g., the publisher) is prohibited.
8.4. In case of infringement, we may immediately terminate cooperation, block course access, and, if necessary, take legal action.
9. Prohibited Conduct
9.1. You must use the Platform in accordance with applicable law, these Terms, and good practice. In particular, you must not:
-
share your User account or disclose login credentials to third parties;
-
attempt unauthorised access to Platform resources or features not assigned to your account;
-
disrupt Platform or IT system operation (e.g., malware, hacking, or similar techniques);
-
use your account for marketing, promotional, or sales activities unrelated to language learning within Edu-Dutch courses;
-
infringe copyrights in Platform materials, including copying, distributing, modifying, or sharing content without our consent;
-
use tools on the Platform (chats, comments, groups) in ways that infringe personal rights, violate good practice, or offend public decency;
-
publish prohibited content, including profanity, offensive, hateful, discriminatory content, or content contrary to the Annex.
9.2. If any of the above prohibitions are breached, we may block access to the User account and thus to purchased courses. The User will receive reasons by email. The User may appeal within 14 days of receiving the notice. Appeals are reviewed within 14 days of receipt.
10. Right of Withdrawal
10.1. If you are a Consumer or a Sole Proprietor Acting as a Consumer (PNPK), you have the right to withdraw from a distance contract with Academy Edu-Dutch without giving reasons within 14 days of conclusion—except in the cases in Sections 5, 6, and 7, in particular where:
-
you consented to the start of the course (e.g., group or individual online classes) before the 14-day period expired;
-
you obtained access to full digital content (e-learning) not supplied on a tangible medium;
-
a paper book or other personalised educational materials were sent to you as part of the course.
10.2. To exercise the right of withdrawal, send a statement by email to info@edu-dutch.com. You may use a model withdrawal form, but it is not mandatory.
10.3. Upon effective withdrawal:
-
your access to the purchased course is revoked;
-
we refund all payments received from you without undue delay and no later than 14 days from receiving your withdrawal statement.
10.4. Refunds are made using the same payment method you used, unless you expressly agree to a different method that does not incur additional costs for you.
11. Complaints
11.1. Academy Edu-Dutch provides electronic services with due care and in compliance with applicable law.
11.2. For purchased Courses (e-learning, group, or individual), we are liable to Consumers and PNPKs for conformity with the contract, under the Polish Consumer Rights Act of 30 May 2014.
11.3. If a Course is non-conforming (e.g., errors preventing learning, non-functional lessons, content not provided), you have the right to file a complaint by email to info@edu-dutch.com.
11.4. Please include in your complaint:
-
identifying details (name, surname, email linked to the account);
-
order number (if available);
-
description of the lack of conformity;
-
your preferred resolution.
11.5. We review complaints without undue delay, no later than 14 calendar days from receipt, and notify you of the outcome by email.
11.6. If you are a Consumer, you may also use out-of-court dispute resolution methods, in particular:
-
the permanent consumer arbitration court;
-
mediation by the Provincial Inspectorate of Trade Inspection;
-
assistance from a municipal or district consumer ombudsman;
-
the ODR platform run by the European Commission: https://ec.europa.eu/consumers/odr

12. Privacy
12.1. The controller of personal data of course participants is Kinga Fiebig, Director of Academy Edu-Dutch B.V., with registered office at Tine van Dethstraat 81, 2331 CD Leiden, Nederland, who processes personal data to perform the contract, operate the User account, and ensure Platform functionality.
12.2. Using the Platform involves processing personal data and using cookies and similar tracking technologies.

13. Other Provisions
13.1. Prices displayed on the Platform may change. Price changes do not affect orders placed before the change—the price valid at contract conclusion applies.
13.2. We may amend the Terms for important reasons, in particular:
-
changes in applicable law;
-
technological changes affecting Platform operation;
-
organisational or business changes at Academy Edu-Dutch.
13.3. If you have a User account, you will be notified of amendments by email sent to the address linked to your account.
13.4. If an amendment materially and adversely affects your ability to use your account or the purchased Course, you have the right to terminate the contract within 30 days from receiving the notice of change.
Annex to the Terms – Rules for User-Provided Information
Ability to provide information
When using the Platform, you may provide information that—at your request—is stored in the Platform’s IT system, e.g., comments, questions, forum posts, or profile data.
Prohibited content
You must not publish or send information that:
-
constitutes illegal content within the meaning of Regulation (EU) 2022/2065 (DSA);
-
infringes intellectual property, personal rights, or fair-competition rules;
-
is misleading or spam;
-
promotes violence, hatred, discrimination, or totalitarian ideologies;
-
is offensive, vulgar, misogynistic, chauvinistic, or offensive to religious feelings;
-
harms the good name of Academy Edu-Dutch.
Reporting illegal content
Anyone may report illegal content by emailing info@edu-dutch.com. A report should include:
-
justification of the report;
-
the exact location (URL) of the content in question;
-
contact details of the reporting person (unless the report concerns offences listed in Directive 2011/93/EU);
-
a statement that the report is made in good faith.
Handling of reports
-
Reports are reviewed within 14 days.
-
If incomplete, the user will be asked to supplement the report.
-
We will notify the reporter by email of the decision, with reasons and information on appeal options.
Measures we may take in case of a violation
Depending on the severity and nature of the violation, we may:
-
limit the visibility of or remove content;
-
block the ability to add new content;
-
temporarily block the user account;
-
permanently remove the account.
Appeals
You may appeal our decision within 14 days of receiving it by sending a reasoned appeal to info@edu-dutch.com. We will review appeals within 14 days.
No automation
All reports, decisions, and appeals are reviewed manually by the Academy Edu-Dutch team—we do not use automated filtering or automated decision-making.
Abuse reporting
In cases of repeated, clearly unfounded reports, we may suspend acceptance of reports from the given user after prior warning.
