REGULATIONS OF SALES OF SERVICES AND PRODUCTS IN EDU-DUTCH

1 General

  1. This online store is run by Kinga Fiebig and Jelmer Hiemstra, running a business under the name EDU-DUTCH with a permanent place of business at Tine van Dethstraat 81, 2331 CD Leiden; KVK: 58783210
  2. In all matters related to the functioning of the online store, please contact us at the following e-mail address: info@edu-dutch.com.
  3. The Regulations define the general terms and conditions of using the Store as well as the rights and obligations of the Seller and the Buyer.
  4. Through the Store, the Seller provides the Buyer with the opportunity to conclude a contract for the sale of products available in the Store and to conclude a contract for the supply of digital content in the form of stationary courses, online courses and other electronic products. The Seller also provides electronic services to the Buyer.
  5. By placing an order on the Website, you declare that you have read these Sales Regulations and accept its provisions, and consent to the processing of personal data in the manner and for the purposes set out in these Regulations.

2 Definitions

For the purposes of these Regulations, the following meanings of terms are assumed:

  1. Regulations - this document defining the rules for the sale of services via the website at: www.edu-dutch.com  ;
  2. Website - the website www.edu-dutch.com, containing the e-Learning platform with the option of purchasing the Service, created by the Service Provider as part of the creator of the electronic educational platform at www.edu-dutch.com provided by the entrepreneur Kinga Fiebig and Jelmer Hiemstra, Tine van Dethstraat 81, 2331 CD Leiden: KVK: 58783210
  3. Service Provider - Service Provider: Edu-Dutch, with registered office at Tine van Dethstraat 81, 2331 CD Leiden.

  5. Customer - a natural person with full legal capacity, a natural person conducting business activity, a legal person, an organizational unit that is not a legal person, to which the law grants legal capacity, using the Service;
  6. Consumer - a customer who is a natural person performing a legal act not directly related to its business or professional activity;
  7. Entrepreneur with consumer rights - a natural person concluding a contract directly related to his business activity, when the content of this contract shows that it is not of a professional nature for him, resulting in particular from the subject of his business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity;
  8. E-course - materials in the form of video or audio recordings, or in the form of PDF files, posted on the Website, access to which may be made available to the Customer for a fee or free of charge;
  9. Customer Account - an individual, electronic account activated for the Customer in order to enable him to use the Service;
  10. Agreement - Agreement for the provision of the Service;
  11. Service - a service provided by the Service Provider to the Customer consisting in conducting stationary classes
  12. Online service - a service provided by the Service Provider to the Customer, consisting in providing the Customer with access to the e-learning Platform containing courses in the form of video or audio recordings, or in the form of PDF files and Subscriptions; and running online courses.
  13. Subscription Period - 6-12 months starting from the date of receipt by the Service Provider of confirmation of payment for the Service by the Customer;
  14. Fee/Price – a payment specified by the Service Provider for the Service provided by the Service Provider to the Customer, the amount of which depends on the subscription period selected by the Customer;
  15. Consumer Rights Act - the Consumer Rights Act of May 30, 2014 (i.e. Journal of Laws of 2020, item 287, as amended);
  16. Regulation on the protection of personal data - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC ( General Data Protection Regulation) of April 27, 2016 (Journal of Laws UE L 119 of 04/05/2016);
  17. Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws of 2020, item 344);
  18. Civil Code - The Civil Code Act of April 23, 1964 (i.e. Journal of Laws of 2020, item 1740, as amended).

3. Conditions of concluding the contract

  1. In order to access the Service, the Customer registers a Customer Account on the Website.
  2. The agreement between the parties is concluded at the moment of completing the registration of the Customer Account on the Website.
  3. The completion of the Customer Account registration on the Website is confirmed by the Service Provider by e-mail.
  4. During registration, the Customer is obliged to provide true and up-to-date data necessary for the provision of the Service by the Service Provider.
  5. By registering the Customer's account on the Website, the Customer who is a consumer declares that in accordance with art. 15 sec. 3 of the Act on Consumer Rights, demands the commencement of the provision of services covered by the order before the deadline for submitting a declaration of withdrawal from the contract, and therefore acknowledges the fact that in the event of exercising the right to withdraw, he will be obliged to pay remuneration for services performed until the withdrawal services.

4. Prices and Payments and Terms of Service

  1. After creating a Customer account on the Website, the Customer selects and pays for access to the Service in accordance with the Prices applicable on the Website.
  2. If, after the end of the Subscription period, the Customer does not pay for access to the Service, access to the Service is blocked and the Service Agreement is terminated.
  3. The prices posted on the Website are given in euros and are gross prices.
  4. Electronic payments on the Website are made via the website: Stripe
  5. Edu-Dutch reserves the right to cancel or reschedule a face-to-face or online tutored course if enrollment for a group course is too small. The new date is agreed upon with the already registered students. If a course is completely canceled by Edu-Dutch, course fees that have already been paid will be refunded to participants.
  6. If an Edu-Dutch lesson is canceled due to circumstances, Edu-Dutch will ensure that the lesson is taken at a different time. A different date and time are agreed with the students.
  7. If a student would like to transfer an individual online lesson, this must be done at least 24 hours before the start of the scheduled class, otherwise a fee will be charged. The transfer of lessons should take place in the same week, otherwise a fee will be charged. The new day and time will be agreed with the teacher
  8. If payment is made by bank transfer, it must be in your Edu-Dutch account at least 1 day before the start of the first lesson (account number: NL22 INGB 0006 168436)
  9. In the event of early termination of a full-time or online course with a teacher by the student, no refund/costs for the course are due.
  10. If, due to exceptional circumstances, a course must be terminated by the student, an appropriate solution may be considered in consultation with Edu-Dutch by e-mailing: info@edu-dutch.com
  1. Each course/level ends with an online exam. After passing the exam, the student will receive a certificate by e-mail along with the achieved level of proficiency in the Dutch language.
  2. On request, it is possible to issue a declaration of student participation in a Dutch language course (e.g. for an employer).

5. Copyright

The content posted on the Website and received as part of the provision of the Service by the Website are the property of the Service Provider and are subject to protection. It is forbidden to use them commercially, resell, duplicate and share them with other people without the consent of the author.

6. Right of withdrawal

  1. If during the purchase of the Product, the Consumer or Entrepreneur with consumer rights agreed to perform the contract and provide him with digital content in the form of the purchased product before the deadline to withdraw from the contract, he loses the right to withdraw from the contract concluded with the Seller.
  2. In a situation where the circumstances indicated above do not occur, the Consumer or Entrepreneur with consumer rights has the right to withdraw from the contract under the conditions indicated below.
  3. Withdrawal from the contract takes place by informing the Service Provider of your decision by submitting a statement sent by traditional mail or e-mail.
  4. The Service Provider provides a template of the Agreement Withdrawal Form - constituting Annex No. 1 to these Regulations. Failure to use the form in the withdrawal process does not invalidate the withdrawal.
  5. To meet the deadline for withdrawal from the contract, it is enough to send a statement of withdrawal to the correspondence address or e-mail address of the Service Provider before its expiry.
  6. In the event of withdrawal from the contract, the Service Provider returns to the Consumer or Entrepreneur with consumer rights all payments received from him.
  7. The refund will be made using the same payment methods that were used by the Consumer or Entrepreneur with consumer rights in the original transaction, unless the Consumer or Entrepreneur with consumer rights clearly indicated a different solution.

7. Terms of Service

  1. The use of the Website by the Customer is possible provided that a computer with Internet access and the following web browsers are used: IE11+, Firefox, Chrome, Opera, Safari - in the latest versions available as of March 23, 2023.
  2. The Customer does not acquire any rights to the software on the Website.

8. Rights and obligations of the service provider

  1. The Service Provider undertakes to provide the Customer with the Service consisting in providing the Customer with access to the Website - an e-learning platform containing courses in the form of video, audio recordings or in the form of PDF files.
  2. The Customer is not entitled to download - duplication of permanent materials and software located on the Website, neither in full form nor in parts.
  3. The Service Provider reserves the right to deprive the Customer of access to the Service in the event of a breach of the Customer's rights and obligations.

8.1 Rights and obligations of the service provider

  1. The Service Provider will enable the Customer to use technical support services for the Service.
  2. Technical support consists in providing the Service Provider with advice and explanations regarding the functioning of the Service.
  3. Technical support is provided via e-mail info@edu-dutch.com or by completing the contact form on the Website.
  4. The Service Provider reserves the right to make temporary breaks in the operation of the System for maintenance and repair purposes, and in particular for the purpose of updating and expanding the System.

9. Rights and Obligations of the Client

  1. Within the scope of the Website, it is forbidden for Users to post content that is contrary to applicable law, moral, moral and social norms and the provisions of these Regulations. In particular, it is forbidden to post Materials that:
    • contain profanity,
    • infringe copyright,
    • they call for breaking the law
    • contain pornographic content,
    • contain content that promotes the use of drugs or illicit drugs,
    • contain racist, anti-Semitic, nationalistic, aggressive, homophobic content;
    • messages commonly regarded as "spam",
    • distribute or encourage the download of computer viruses or malware/malware,
    • are direct attacks on other Users
    • contain personal data, including contact details or e-mail addresses;
    • serve political, religious or other agitation;
    • are a copy of previously posted comments or entries,
    • infringe the personal rights of third parties.
  2. It is forbidden to use the Website in a way that makes it difficult for other Customers to use it, causing disruptions in its operation.
  3. It is forbidden to post third party materials under your name and to impersonate other people.
  4. It is forbidden for the Customers to post on the Website advertising messages in any form or content aimed at promoting services or goods without the consent of the Service Provider.

10. Liability for defects

  1. The Service Provider's obligation is to provide the Buyer with a product free from physical or legal defects.
  2. In order to submit a complaint, the Buyer may use the complaint form attached as Appendix 2 to these Regulations.
  3. All complaints regarding the Service should be submitted by e-mail to the following address info@edu-dutch.com or in writing to the Service Provider's address.
  4. It is recommended that the Customer provide the following information in the description of the complaint: legible identification of the Customer, allowing for identification in the system, description of the fault/error/defect, together with an indication of the time of its occurrence, providing the version and name of the web browser on which the indicated problem occurs.
  5. Providing the above-mentioned information and circumstances will make it easier to process the complaint. This information does not affect the effectiveness of complaints submitted without the recommended description of the complaint.
  6. The Service Provider will notify the Customer about the consideration of the complaint and its result in a message sent to the e-mail or correspondence address provided by the Customer in the complaint, within 14 days.
  7. Details regarding the Seller's warranty for defects are regulated by the provisions of the Civil Code

11. Protection of Personal Data

  1. The administrator of the Customers' personal data within the meaning of the Regulation on the Protection of Personal Data is the Service Provider, i.e. Kinga Fiebig, running a business under the name of Edu-Dutch with a permanent place of business at Tine van Dethstraat 81, 2331 CD Leiden; KVK: 58783210
  2. The Service Provider ensures the protection of personal data entrusted to it by Customers for processing.
  3. The processing of personal data is carried out in accordance with the provisions of applicable law, in particular in accordance with:
    1. Regulation on the protection of personal data;
    2. They will act on the provision of electronic services and relevant executive acts to this act.
  4. The processing of Customers' personal data takes place in order to ensure the proper performance of the Service, informing Customers about the Service Provider and the services provided by him, and for other purposes if the Customer gives a separate, explicit consent.
  5. Under the Agreement, the Service Provider processes the following personal data of Customers: name, surname, address of residence/business activity, company name, e-mail address, contact telephone number.
  6. Providing personal data by customers is voluntary, however, it is necessary to perform the Service.
  7. Detailed information on the protection of personal data is regulated by the Privacy Policy and cookies, is available on the Website in the Privacy Policy tab.

12. Final Provisions

  1. These Regulations may be subject to change. For contracts concluded before the amendment to the Regulations, the Regulations in force on the date of conclusion of the contract shall apply.
  2. In matters not covered by these Regulations, the provisions of Dutch law shall apply, including the Civil Code, the Act on consumer rights or other laws applicable to the operation and functioning of the online store in force in the Netherlands.
